Under the Immigration and Nationality Act, a wide variety of employment based immigration visas are available when an employer is able to successfully demonstrate that there are no American workers available to fill a particular position. Employment Based Immigration Visas fall into five separate categories, as listed below.
First Preference (EB-
Must be able to show extraordinary ability in any of a number of specialized fields,
including education, business, arts & sciences; -
Must be an outstanding Professor or Researcher in a given field of academia; -
Must be a multi-
Second Preference (EB-
Must possess an advanced degree or its equivalent;
Must be able to demonstrate exceptional ability in the field of arts, sciences or business.
Third Preference (EB-
Must demonstrate that you are a skilled worker with at least two years’ experience;
Must be able to prove that you hold a professional undergraduate degree; -
