Under the Immigration and Nationality Act, a wide variety of employment based immigration visas are available when an employer is able to successfully demonstrate that there are no American workers available to fill a particular position. Employment Based Immigration Visas fall into five separate categories, as listed below.


First Preference (EB-1)

Must be able to show extraordinary ability in any of a number of specialized fields, including education, business, arts & sciences; -or-

Must be an outstanding Professor or Researcher in a given field of academia; -or-

Must be a multi-national manager or executive.


Second Preference (EB-2)

Must possess an advanced degree or its equivalent;

-or-

Must be able to demonstrate exceptional ability in the field of arts, sciences or business.


Third Preference (EB-3)

Must demonstrate that you are a skilled worker with at least two years’ experience; -or-

Must be able to prove that you hold a professional undergraduate degree; -or-

If you are an unskilled non-seasonal worker, you must prove that you are able to perform work that is unable to be performed by U.S. workers.


Fourth Preference (EB-4)

Available for those deemed “special immigrants” and includes Religious Workers,  physicians, members of the armed forces, broadcasters, and Iraqis who have provided assistance to the United States. Call for additional information.


Fifth Preference (EB-5)

An EB-5 Visa is available to those parties deemed Immigrant Investors involved in a commercial enterprise that will create jobs in the United States.
